Por las razones anteriormente expuestas, este JUZGADO SEXTO DE MUNICIPIO EJECUTOR DE MEDIDAS E ITINERANTE DE PRIMERA INSTANCIA EN LO CIVIL, MERCANTIL, TRÁNSITO Y BANCARIO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ÁREA METROPOLITANA DE CARACAS, administrando Justicia en nombre de la REPÚBLICA BOLIVARIANA DE VENEZUELA y por autoridad de la Ley, DECLARA PARCIALMENTE CON LUGAR LA DEMANDA incoada por el ciudadano CLAUDIO PIETRO IADE DONELLI, en contra de la sociedad mercantil COSTA RIVIERA CARENERO, C.A., todos identificados ut supra, en consecuencia se DECLARA: PRIMERO: SE RESUELVE el contrato de opción a compra, otorgado en fecha tres (3) de noviembre de mil novecientos noventa y ocho (1998), por ante la Notaría Pública Séptima del Municipio Sucre del estado Miranda, quedando anotado bajo el No. 51, Tomo 56 de los Libros de Autenticaciones llevados por dicha Notaría, suscrito entre la parte actora, ciudadano CLAUDIO PIETRO IADE DONELLI y la parte demandada, sociedad mercantil COSTA RIVIERA CA.....
